Operation Hector submissions timetable

On 10 May 2023, the Commission adjourned the public inquiry in Operation Hector.

Due to unforeseen personal circumstances affecting Counsel Assisting, which are outside the Commission’s control, the Chief Commissioner has directed an amendment to the timetable for the provision of written submissions in Operation Hector as follows:

1.    Submissions of Counsel Assisting to be provided to relevant persons (or their legal representatives) by 17 July 2023 (amended from 6 July).
2.    Submissions in response to the submissions of Counsel Assisting are to be provided to the Commission by 7 August 2023 (amended from 27 July).

On 17 July 2023, the Commission advised that the timetable for Counsel Assistings' submissions has been extended to Monday, 24 July 2023 due to further work being undertaken by Counsel Assisting. All submissions in reply were then due by 14 August 2023.

On 8 August 2023, the Commission advised that it has considered and granted extensions to the timetable for submissions in response from three of the parties (or their legal representatives) as follows:  Kevin Watters to 21 August 2023; Abdal Aziz to 24 August 2023; and Nima Abdi to 28 August 2023. On 17 August 2023, a further extension to 28 August 2023 was granted to Kevin Watters. On 22 August 2023, a further extension to 28 August 2023 was granted to Abdal Aziz. On 29 August 2023, a further extension to 4 September 2023 was granted to Nima Abdi.

On 31 August 2023, the Commission served its corruption prevention submissions on the relevant parties. The Chief Commissioner directed that any submissions in reply must be received by close of business on 22 September 2023.

On 3 November 2023, the Commission served further submissions of Counsel Assisting on those parties to whom Counsel’s further submissions are in reply. The Chief Commissioner directed that any submissions in reply to Counsel Assisting’s further submissions must be received from those parties by close of business on 17 November 2023.  

On 6 November 2023. the Chief Commissioner approved an extension of time to one of the parties to provide submissions in reply to the further submissions of Counsel Assisting served on 3 November. Those submissions are now due by 24 November 2023.

Submissions of Counsel Assisting will only be served on relevant parties. All submissions will be subject to a non-publication direction pursuant to section 112 of the Independent Commission Against Corruption Act 1988.

The Commission will not be making further comment.
